Terms of Service

Effective date: 13 July 2026

These Terms of Service (“Terms”) are a legal agreement between Atwork Solutions (“Atwork”, “we”, “us”) and the individual or organization that creates an account or uses our website, workspace platform and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” means that organization.

1. Definitions

  • “Customer” — the person or organization that owns a workspace and is responsible for it.
  • “User” — anyone the Customer permits to access its workspace, including members and guests.
  • “Customer Content” — the data, files and other content that Customer and its Users submit to or create in the Service.

2. Your account

You must provide accurate registration information and keep it up to date. You are responsible for your account, for keeping credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You must be at least 16 years old to use the Service.

3. The Service and licence to use it

Subject to these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes during your subscription. We may update, improve or modify the Service over time. We do not sell you the software; all rights not expressly granted are reserved.

4. Plans, fees and payment

Paid plans are billed per seat on a monthly or annual basis, in advance. Fees are stated exclusive of taxes, which you are responsible for. Unless required by law, fees are non-refundable. Paid subscriptions renew automatically for the same period unless cancelled before the renewal date. You may upgrade, downgrade or cancel at any time; upgrades may be prorated, and downgrades take effect at the next renewal. If a payment fails or is overdue, we may suspend or downgrade the Service after reasonable notice.

5. Free plans and trials

Free plans and trials are provided “as is” and may be changed or discontinued at any time. We may set usage limits on free plans.

6. Customer Content

As between you and us, you own your Customer Content. You grant us a worldwide, non-exclusive licence to host, store, process, transmit, display and otherwise use Customer Content solely to provide, secure and improve the Service for you and your Users, and as otherwise permitted by these Terms and our Privacy Policy. You are responsible for your Customer Content, including that you have the necessary rights to it and that it does not violate any law or third-party rights. Where Customer Content contains personal data, our processing is also governed by our Data Processing Agreement.

7. Acceptable use

You agree not to, and not to permit anyone to:

  • use the Service in violation of any law or third-party rights;
  • upload or transmit malicious code, or content that is unlawful, infringing or harmful;
  • attempt to gain unauthorized access to, disrupt or overload the Service or its infrastructure;
  • reverse-engineer, copy or create derivative works of the Service, except as permitted by law;
  • resell or provide the Service to third parties except as expressly allowed; or
  • use the Service to send unsolicited communications or to build a competing product.

8. Third-party services and integrations

The Service may interoperate with third-party services that you choose to connect. Those services are governed by their own terms, and we are not responsible for them. Enabling an integration may involve sharing data with the third party at your direction.

9. AI features

The Service includes AI features that generate output based on your inputs and workspace content. AI output may be inaccurate or incomplete; you are responsible for reviewing it before relying on it, and you must not use AI features for prohibited or high-risk purposes. AI usage may be subject to fair-use or plan limits.

10. Intellectual property

The Service, including its software, design, and trademarks, is and remains our property (or our licensors’) and is protected by law. If you give us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation to you.

11. Privacy and data protection

Our handling of personal data is described in our Privacy Policy. Where we process personal data on your behalf as a processor, our Data Processing Agreement applies and forms part of these Terms.

12. Term and termination

These Terms apply while you use the Service. You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay, or to protect the Service, our users or the public — with notice where practicable. On termination, your right to use the Service ends. For a reasonable period after termination you may export your Customer Content; after that we may delete it in accordance with our Privacy Policy and the DPA. Sections that by their nature should survive termination will survive.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.

14. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You will defend and indemnify us against claims, damages and costs arising from your Customer Content, your use of the Service in breach of these Terms, or your violation of law or third-party rights.

16. Changes to the Service and to these Terms

We may modify the Service and update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example by email or in-product). Changes take effect on the date we post them, and your continued use of the Service means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the competent courts of the Netherlands, unless mandatory local law provides otherwise for consumers.

18. General

These Terms, together with the Privacy Policy and, where applicable, the DPA and any order form, are the entire agreement between us regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control.
